Emergency physicians should talk to their state legislators and representatives who may be passing legislation within their state regarding what constitutes fair payment, Dr. Bregier suggested.

ACEP members and state chapters can look to NCOIL’s disclosure language and ACEP’s fair payment policies and model legislation “as a way to respond to payers’ efforts to turn emergency care providers into their indentured servants,” Dr. Riner said. “Emergency physicians should take every opportunity to promote usual, customary and reasonable charges as a market-driven standard for fair payment for out-of-network services.”
